Participation has different rights
German codetermination makes information, consultation, negotiation, and co-decision distinct institutional obligations rather than discretionary engagement.
Premise
German Mitbestimmung structures employee participation through defined legal institutions. At establishment level, the Betriebsrat or works council represents employees under the Works Constitution Act; at company level, separate codetermination statutes can place employee representatives on supervisory boards of qualifying companies. For executives, the central distinction is that communication is not merely encouraged. Depending on the issue, timing, information, consultation, consent, negotiation, and escalation can be legally specified.
